Terms of Service
Welcome to HD Nail Bar & Lashes and to the online booking, check-in, rewards, and text messaging services we offer (the “Services”).
1. Acceptance of Terms
By accessing or using the Services, you agree to be bound by these Terms of Service, including our Privacy Policy (together, the “Terms”). If you do not agree with these Terms, you may not use the Services.
We may update these Terms from time to time and will post the updated Terms on this page with a new “Last updated” date. If a change reduces your rights or increases your responsibilities, we will make reasonable efforts to notify you. Continued use of the Services after the updated Terms take effect means you accept them. If you do not accept the updated Terms, your only remedy is to stop using the Services.
2. User Information
To book an appointment, check in, or join our rewards program, you may need to provide personal information such as your name and mobile phone number. You agree to provide accurate, complete, and current information and not to impersonate another person.
Children under the age of 13 may not use the Services, and we do not knowingly collect information from children under 13.
3. Scope of Services
The Services let you request appointments, check in at the salon, receive appointment notifications, and take part in our rewards program. Appointments booked online are requests and may be confirmed, rescheduled, or cancelled by the salon.
4. Express Written Consent to Text Messages
If you check the SMS consent box on our booking form, you agree to receive automated text messages from HD Nail Bar & Lashes at the mobile number you provided, about your appointments, including booking confirmations, reminders, and updates. These messages may be sent using an automated system. Consent is not required to book an appointment or make a purchase. Message and data rates may apply.
5. No Abuse or Interference
You agree not to abuse, disrupt, or interfere with the Services. In particular, you agree not to: (i) misrepresent your identity or book appointments on behalf of others without their consent; (ii) submit false, fraudulent, or excessive bookings; (iii) use any robot, script, or other automated means to access or copy the Services; (iv) attempt to gain unauthorized access to our systems or other users’ information; (v) upload viruses or other harmful code; or (vi) use the Services to violate any law or regulation.
6. Compliance with Laws
You agree to use the Services only in compliance with all applicable local, state, and federal laws. We operate our text messaging program in accordance with the Telephone Consumer Protection Act (TCPA) and applicable wireless carrier and CTIA guidelines.
7. Termination of Services to You
We may suspend or end your access to all or part of the Services, and cancel any booking, if we reasonably determine that you have violated these Terms. You may stop using the Services at any time.
8. Modifications to Services
We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable for any modification, suspension, or outage of the Services, including outages caused by third-party providers or the internet.
9. Intellectual Property
The Services, including our name, logo, website content, and software, belong to HD Nail Bar & Lashes or its licensors and are protected by copyright and trademark laws. You may not copy, modify, distribute, or reverse engineer any part of the Services without our prior written permission.
10. Privacy
Your privacy is important to us. Any information collected through the Services is handled as described in our Privacy Policy. We do not sell or share your mobile phone number or SMS consent with third parties for their marketing purposes.
11. Disclaimer of Warranties
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free, or that any text message will be delivered.
12. Limitation of Liability
To the fullest extent permitted by law, HD Nail Bar & Lashes and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Services. Our total liability to you for any claim related to the Services will not exceed the amount you paid us, if any, for the Services. Some jurisdictions do not allow these limitations, so they may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless HD Nail Bar & Lashes and its owners, employees, and agents from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
14. Choice of Law and Forum
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be brought in the state or federal courts located in Philadelphia County, Pennsylvania, and you consent to the jurisdiction of those courts.
15. General Provisions
Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Services.
Severability. If any provision is found unenforceable, the remaining provisions stay in effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not transfer your rights under these Terms without our written consent.

We may send you notices by text message (if you have opted in), by email if you provided one, or by posting them on this page.
17. Mobile Messaging Terms (SMS Program)
- Program name: HD Nail Bar & Lashes Appointment Alerts.
- Program description: Automated text messages about appointments you book with us, including booking confirmations, reminders, and updates.
- How to opt in: Enter your mobile number on our online booking form and check the SMS consent box, which is never pre-checked. Consent is not a condition of booking or of any purchase.
- Message frequency: Up to 4 messages per appointment booked. Frequency varies.
- Cost: Message and data rates may apply depending on your mobile phone service plan.
- How to opt out: Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message at any time. You will receive one final message confirming you have been unsubscribed, and no further messages will be sent. Reply START or UNSTOP to subscribe again.
- Help: Reply HELP to any message for assistance, or contact us using the details below.
- Supported carriers: Participating carriers include, but are not limited to, AT&T, T-Mobile, Verizon Wireless, US Cellular, Boost Mobile, Cricket Wireless, Metro by T-Mobile, Google Voice, and other regional carriers.
- Carrier liability: Wireless carriers are not liable for delayed or undelivered messages.
- Privacy: See our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
18. Rewards
Rewards offered through our rewards program are set by HD Nail Bar & Lashes, have no cash value, and may be changed or ended at any time. Rewards cannot be transferred unless we state otherwise.
